The MySwimCuts website and application (the "Service") are operated by Little Orange Lamb, LLC ("MySwimCuts," "we," "our," or "us"). This Privacy Policy describes what information we collect, how we use it, when we share it, and the choices available to you regarding your personal information.

5. Children's Privacy (COPPA)

MySwimCuts is designed for swimmers of all ages, including children under 13. We take children's privacy seriously. This section describes the practices we follow for child accounts, including the parental notice and verifiable consent process required before any child's personal information is collected, the limited information we collect about children, and the rights parents have over their child's information.

5.1 Parent Accounts

Children under 13 may not create accounts directly. A parent or legal guardian must create and manage the account.

5.2 Verifiable Parental Consent

A child under 13 may not be added to the Service unless a parent or legal guardian completes our verifiable parental consent process. Before providing consent, the parent receives a direct notice describing the categories of personal information we collect from the child, how we use that information, and the third parties to whom it is disclosed.

As part of the consent process, we use a method reasonably calculated to ensure that the person providing consent is the child's parent or legal guardian: we confirm that the person holds a valid credit or debit card by processing a nominal charge (currently $0.50). This charge is an actual monetary transaction that will appear on the cardholder's statement, giving the cardholder notice of and the opportunity to object to the account creation.

To provide the Service, we disclose the child's profile and performance information — the specific data fields listed in Section 6.2 — to our artificial intelligence service provider for the sole purpose of generating the personalized race plans that are the core function of the Service. The child's name is not shared with our AI provider. This disclosure is integral to the Service; the Service cannot be provided without it. Our AI provider is contractually restricted from using this information for any other purpose, including training AI models.

Verification must be successfully completed before a child account is created and before any personal information about the child is collected or processed. If a parent begins but does not complete the consent process within 30 days, we delete all information collected in connection with the attempted registration.

5.3 Information Collected from Children

For child swimmer accounts, we collect only the information reasonably necessary to provide the Service, including:


We do not knowingly collect email addresses directly from children under 13, and we do not knowingly direct marketing communications to children. The general categories described in Section 2.1, including information voluntarily submitted beyond the items listed above, do not apply to child accounts: for child accounts, collection is limited to the items listed in this Section 5.3.

Parents can review and correct their child's information directly through their parent account. To request deletion or withdraw consent, parents may use the account settings in their parent account or contact us at privacy@myswimcuts.com. For requests made by email, we will verify the requester's identity by confirming the request through the parent email address associated with the account before taking action.

Withdrawing consent or requesting deletion will end our ability to provide the Service for that child, and the child's account will be closed. Deletion is carried out on the timeline described in Section 7.2 and extends to our service providers as described there.

There is no charge for exercising these rights, and we will not deny a child access to the Service on the condition that the parent permit more collection or disclosure than is reasonably necessary to provide it.

5.5 Technical Data and Internal Operations

In connection with child accounts, we collect certain technical information — IP address, device and browser type, and session identifiers — solely to support the internal operations of the Service. Specifically, we use this information to: maintain user sessions and authenticate logins; secure the Service and detect fraud or unauthorized access; diagnose technical problems; analyze and improve the functioning of the Service; and maintain the functioning of the Service.

We do not use this technical information to contact any child, to build profiles for advertising, or for any purpose beyond the internal operations described above, and we do not permit our service providers to do so.

5.6 Minors Aged 13 to 17

Swimmers aged 13 to 17 may hold their own accounts with the consent of a parent or legal guardian, as described in our Terms of Service, or be managed under a parent account. The same data practices described in this Privacy Policy apply to their information, including the limited AI disclosure described in Section 6.2, the retention practices in Section 7, and our commitments not to sell personal information, direct marketing based on their data, or use their information for advertising. Parents or guardians of minors may contact us at privacy@myswimcuts.com with questions or requests regarding their teen's information.


6. How We Share Information

We share personal information only as necessary to operate the Service.

6.1 Service Providers

We share personal information with the following categories of service providers, in each case only the information necessary for the provider to perform its function:


Each provider is contractually required to use personal information only to perform services for us, and to maintain its confidentiality and security. A current list of our service providers is available upon request at privacy@myswimcuts.com.

6.2 AI Processing

To generate the personalized race plans that are the core function of the Service, we disclose swimmer profile and performance information to our artificial intelligence service provider. This information consists of: age, gender, stroke preferences, self-rated performance metrics (starts and turns), race event, current and goal times, splits and stroke counts where provided, and recent race history (dates and times only — meet names are excluded). We do not share the swimmer's name with our AI provider.

Our AI provider processes this information solely to provide the Service. It is contractually prohibited from using submitted information for any other purpose, including training or improving general-purpose AI models, and is required to maintain the confidentiality and security of this information.

Because the Service is used by minors, this processing includes information about children under 13 where a parent has completed our verifiable parental consent process described in Section 5.2. This disclosure is integral to providing the Service.

If we are involved in a merger, acquisition, or asset sale, personal information may be transferred as part of that transaction. Any successor will be required to honor the commitments in this Privacy Policy with respect to previously collected personal information, including children's personal information, or we will provide notice and obtain any legally required consent before children's personal information is transferred.


7. Data Retention

7.1 General Retention Practices

We retain personal information for as long as your account is active and as needed to provide the Service, manage your subscription, and meet legal, tax, and accounting obligations.

If you close your account or request deletion, we delete your personal information from active systems within 30 days, except for limited billing records we are required to retain for legal and accounting purposes and records of deletion requests and their fulfillment, which we retain as needed to demonstrate compliance with our legal obligations.

Personal information may persist in encrypted backups for up to 7 days after deletion from active systems, after which it is overwritten in the ordinary backup cycle. Backup data is not used for any purpose other than system restoration.

7.2 Retention of Children's Personal Information

We collect children's personal information for the purposes described in Section 5.3: to generate personalized race plans and to track the swimmer's progress over time. Swim performance history is retained while the child's account is active because progress tracking — comparing current performance against past races — is a core function of the Service and requires historical data.

We do not retain children's personal information indefinitely. Children's personal information is deleted as follows:


Deletion requests are honored by our service providers as well: when we delete a child's personal information, we instruct our service providers, including our AI service provider, to delete corresponding information they hold on our behalf.

We retain records of parental consent, deletion requests, and their fulfillment for five years following the deletion of the associated account, after which they are purged. These records are limited to what is needed to demonstrate compliance with our legal obligations.

Children's personal information in backup systems is overwritten within the backup cycle described in Section 7.1.


8. Security

We maintain administrative, technical, and organizational safeguards designed to protect personal information, including encrypted communications (HTTPS/TLS), secure password storage, and access controls.

These safeguards are appropriate to the volume and sensitivity of the personal information we maintain — including the heightened sensitivity of children's personal information — and to the size and complexity of our business.

We maintain internal procedures intended to identify and respond to potential security incidents involving personal information and will take reasonable steps to mitigate harm and comply with applicable legal obligations.

No system is completely secure, and we cannot guarantee absolute security.

MySwimCuts is operated from the United States and is intended primarily for users located in the United States.

If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from your jurisdiction.

By using the Service, you acknowledge this transfer. Where required by applicable law, we will take reasonable measures to protect personal information.


12. Cookies and Similar Technologies

We use cookies and similar technologies that are necessary for the operation and security of the Service.

We may also use limited analytics tools to understand and improve Service performance. We do not use advertising cookies or cross-site behavioral tracking technologies.

For information about technical data collected in connection with child accounts, see Section 5.5.

Our Service does not currently respond to Do Not Track browser signals.


13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last Updated" date and provide additional notice where required by law. If we make material changes to how we collect, use, or disclose children's personal information, we will obtain renewed parental consent before applying those changes to existing child accounts.
