By creating an account or using MySwimCuts ("the Service"), you agree to these Terms of Service ("Terms"). The Service is operated by Little Orange Lamb, LLC ("MySwimCuts," "we," "our," or "us").
If you are creating an account on behalf of a child under 13, you agree to these Terms as the child's parent or legal guardian. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may use the Service only with the consent of your parent or legal guardian, who agrees to these Terms on your and their own behalf.
If you do not agree to these Terms, do not use the Service.
MySwimCuts is a subscription service that generates AI-assisted race strategy plans for swimmers. Plans are produced by an artificial intelligence model and are intended as general training and preparation guidance only.
MySwimCuts is not a licensed coaching service. The plans generated by the Service do not constitute professional athletic coaching, medical advice, or sports medicine guidance. Swimmers and parents should consult a qualified coach before making significant changes to training or race strategy.
You agree to provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
MySwimCuts offers the following subscription plans:
New accounts receive a 7-day free trial. A valid payment method is required to start a trial. You will not be charged during the trial period, with one exception: if you add a child under 13 to your account during the trial, the $0.50 parental-consent verification charge described in Section 5 is processed at that time. If you cancel before the trial ends, you will not be charged any subscription fees.
Subscriptions are billed monthly on the date you initially subscribed. Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge your payment method for all fees due. You agree to Stripe's terms of service, available at stripe.com/legal.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial billing periods.
If a payment fails, we will attempt to retry the charge. Access to the Service may be suspended until payment is resolved.
MySwimCuts takes children's privacy seriously. We do not collect personal information from children under 13 without a parent or legal guardian first completing our verifiable parental consent process, described in Section 5.2 of our Privacy Policy.
How consent works: Before adding a child under 13, the parent receives a direct notice describing the information we collect from the child, how we use it, and the third parties to whom it is disclosed. The parent then provides affirmative consent. We verify that the person providing consent is the account holder of a valid payment card by processing a $0.50 charge. This charge is processed before the child's profile is created and applies separately to each child under 13. The charge appears on your statement as "MYSWIMCUTS COPPA," giving the cardholder notice of and the opportunity to object to the account creation. The date and transaction record of this charge are retained as part of our compliance records.
Parents may review, correct, or request deletion of their child's information, or withdraw consent, at any time — through your parent account or by contacting us at privacy@myswimcuts.com. See our Privacy Policy for full details, including our data retention and deletion practices.

Race plans generated by MySwimCuts are produced by a large language model (AI). While we work to ensure quality and accuracy, AI-generated content may contain errors. We make no guarantees about the accuracy, completeness, or fitness of any plan for a particular swimmer's needs.
Results will vary. MySwimCuts does not guarantee that following a generated plan will result in improved swim times or qualification for any meet or program.
The MySwimCuts name, logo, website design, and underlying software are owned by Little Orange Lamb, LLC and protected by applicable intellectual property laws.

You retain ownership of the swim time data and personal information you enter into the Service. By entering this data, you grant MySwimCuts a limited license to use it to provide the Service to you, including processing by our service providers — such as the artificial intelligence provider that generates race plans — as described in Sections 5.2, 6.1, and 6.2 of our Privacy Policy. This license is limited to providing the Service, ends when the data is deleted in accordance with our Privacy Policy's retention practices, and does not permit us to sell your data or use it for advertising.
Race plans generated by the Service are provided for your personal, non-commercial use. You may not resell, redistribute, or sublicense them.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND NOTHING IN THESE TERMS LIMITS ANY RIGHTS YOU HAVE UNDER APPLICABLE LAW THAT CANNOT BE LAWFULLY LIMITED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITTLE ORANGE LAMB, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
You agree to indemnify and hold harmless Little Orange Lamb, LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
Notwithstanding the foregoing, material changes to how we collect, use, or disclose children's personal information require renewed parental consent as described in our Privacy Policy, and such changes do not take effect for existing child accounts through continued use alone.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account and request deletion of your information at any time through your account settings or by contacting us at privacy@myswimcuts.com. Cancelling your subscription alone does not close your account or delete your information; account data is retained and eventually deleted as described in our Privacy Policy's retention practices.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Durham County, North Carolina.

Entire Agreement. These Terms, together with the Privacy Policy incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings on that subject.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, subject to the commitments regarding personal information in our Privacy Policy.
